Staud, individually, and on behalf of all the qualified electors of the County of Allegheny v. C. Delores Tucker, Secretary of the Commonwealth of Pennsylvania, Leonard C. Staisey, Thomas J. Foerster and William R. Hunt, members of the Board of Commissioners of Allegheny County, Louis Sparverno, I. Martin Wekselman, Livingstone Johnson and Nathan Schwartz, Judges of the Court of Common Pleas of Allegheny County. Order of Commonwealth Court affirmed.

Petition to Commonwealth Court for declaratory judgment. Before WILKINSON, JR., MENCER and BLATT, JJ.

Order entered allowing petition and declaring Act of December 19, 1971, P. L. 630, § 3 to be constitutional. Petitioners appealed.

The Court being equally divided, the order of the Commonwealth Court is affirmed.

Mr. Chief Justice JONES, Mr. Justice EAGEN and Mr. Justice MANDERINO would affirm the order of the Commonwealth Court.

Mr. Justice ROBERTS, Mr. Justice POMEROY and Mr. Justice Nix would reverse the order of the Commonwealth Court.
